Vacation planning if you have a child custody agreement

On Behalf of | Jan 14, 2026 | Child Custody and Visitation

Summer is on the way, and that means that parents are going to start planning for vacations. While this is often challenging, it can become more complex for individuals who have a child custody agreement.

One of the most important things for you to do as you’re embarking on travel planning is to check the custody agreement to find out if there are any limitations or requirements that you need to consider regarding the vacation.

Double-check the dates

In many parenting plans, vacations take priority over the standard parenting time schedule. This provides a measure of flexibility, but it’s critical that you consider the dates because you may have to trade off with your ex. Remember to think about the travel days so you can reduce stress by not having to rush those days.

Consider the vacation location

Some parenting plans have geographical restrictions, which will impact where you can vacation without permission from either your ex or the court. Even if you don’t have any restrictions, you must plan carefully if you want to travel internationally with the kids. For example, the United States Department of State warns that you may need the child’s birth certificate and notarized consent letters if you plan to travel internationally. You will also need to have the child’s passport with you.

If you’re currently working on establishing the parenting plan, ensure that you’re thinking ahead for vacations. Having the terms clearly written can help both parents as they plan. It may be beneficial to work with someone who understands your circumstances and can help to offer options.
