To quote a very famous line from the classic nineteenth-century novel Anna Karenina, “All happy families are alike; each unhappy family is unhappy in its own way.”  Whether or not you are a fan of iconic Russian literature, you can recognize the truth in that statement.  And, when unhappiness leads to spouses or domestic partners seeking divorce, each divorce is different in its own way.

Now, with a prompt 180-degree turn away from that statement, it’s important to remember that in legal terms, there are only two kinds of divorces.  No, not “nice” and “nasty.”  There are contested divorces, and uncontested ones.  What may begin as a simple uncontested divorce may evolve into a contested and contentious one, and a divorce that begins as a contested case may resolve agreeably before its conclusion.  So from two definitions may come many different kinds of legal outcomes.  First, a few brief definitions:

Contested divorces are those in which the two opposing parties do not agree about many or all conditions pertaining to the divorce, including even wanting the divorce itself.  The conditions in question may include how property and assets are to be divided, whether and how much alimony, spousal or child support is to be paid, child custody arrangements, and many other detailed aspects of their previous married life.   The greater the disagreements and the longer they last, the longer and more costly the entire process can take,  adding frustration to an already adversarial, emotional experience.
